Driving while Intoxicated, or DWI, is a dangerous but common violation of New York law that prohibits\u00a0drivers from operating vehicles if they are drunk. The state considers a driver too impaired to drive safely if their\u00a0blood alcohol concentration (BAC) is 0.08\u00a0percent or higher. When a driver is stopped for suspicion of DWI, officers use\u00a0a field sobriety test to determine\u00a0balance and coordination, and\u00a0a breathalyzer to measure BAC. Refusal to submit to testing means\u00a0mandatory revoking of your\u00a0driver’s license for at least 1 year in New York.<\/p>\n

The\u00a0level of impairment caused by alcohol varies from person to person, and depends on five conditions:<\/p>\n
